Please read these Terms of Service carefully before using the Novetofy platform. These terms govern your access to and use of our services, including our website, Chrome extension, and creator dashboard.
1. Acceptance of terms
By accessing or using Novetofy ('the Platform'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. We reserve the right to update these terms at any time, and your continued use of the Platform constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old to use Novetofy. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Accounts created by individuals under 18 will be terminated immediately upon discovery.
3. Creator accounts
When you register as a creator on Novetofy, you are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to keep your information up to date. You are responsible for all activity that occurs under your account.
4. Affiliate links and commissions
Novetofy provides creators with tracked affiliate links to promote brand partners. Commissions are earned when a qualifying sale is made through your unique tracking link. Commission rates vary by brand and are subject to change. Novetofy reserves the right to withhold or reverse commissions in cases of fraud, returns, or violation of these terms.
5. Prohibited conduct
You agree not to engage in any of the following: using automated tools to generate fraudulent clicks or conversions, misrepresenting your identity or audience, spamming or sending unsolicited messages containing your affiliate links, promoting illegal products or services, violating any applicable laws or regulations, or attempting to reverse-engineer or interfere with the Platform.
6. FTC disclosure compliance
As a creator on Novetofy, you are required to comply with the FTC's guidelines on endorsements and testimonials. You must clearly and conspicuously disclose your affiliate relationship whenever you share affiliate links. Failure to comply with FTC disclosure requirements may result in account suspension or termination.
7. Payouts
Commissions are paid out according to our payout schedule, subject to minimum thresholds and verification requirements. Novetofy reserves the right to delay or withhold payments pending fraud review or verification. All payouts are processed in USD unless otherwise specified. You are responsible for all applicable taxes on your earnings.
8. Intellectual property
All content, trademarks, logos, and materials on the Novetofy Platform are the property of Novetofy or its licensors. You may not use, copy, or reproduce any of our intellectual property without prior written consent. By submitting content to the Platform, you grant Novetofy a non-exclusive, royalty-free license to use that content in connection with operating the Platform.
9. Termination
Novetofy reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms of Service. Upon termination, your right to use the Platform ceases immediately. Any earned commissions pending at the time of termination for cause may be forfeited.
10. Limitation of liability
To the maximum extent permitted by law, Novetofy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim arising out of or related to these terms shall not exceed the total commissions paid to you in the three months preceding the claim.
11. Governing law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the courts of New Mexico.
