FTC Disclosure Policy

Transparency is a core value at Novetofy. This FTC Disclosure Policy outlines the legal requirements for affiliate link disclosure and your responsibilities as a creator on our Platform. All creators must comply with these requirements to maintain their account in good standing.

1. What is FTC disclosure

The Federal Trade Commission (FTC) requires that content creators, influencers, and affiliate marketers clearly disclose any material connection they have with brands they promote. A material connection includes receiving payment, free products, commissions, or any other benefit in exchange for promoting a product or service. This requirement exists to ensure consumers can make informed decisions and are aware when content is sponsored or incentivized.

2. Your obligation as a Novetofy creator

As a creator on Novetofy, you earn commissions when your audience purchases products through your affiliate links. This constitutes a material connection under FTC guidelines. You are legally required to disclose this relationship clearly and conspicuously every time you share an affiliate link, regardless of the platform or format you use — whether that is Instagram, TikTok, YouTube, a blog, email newsletter, or any other channel.

3. What a proper disclosure looks like

A proper FTC disclosure must be clear, conspicuous, and placed where your audience will see it before they click your affiliate link. It should not be buried in a wall of text, hidden below a fold, or placed after the link. Examples of acceptable disclosures include: 'This post contains affiliate links. I may earn a commission if you make a purchase at no extra cost to you.', '#ad', '#sponsored', '#affiliate', or 'Paid partnership with [Brand]'. The disclosure must be in the same language as the content and visible without requiring the viewer to take any additional action.

4. Platform-specific requirements

Different platforms have their own built-in disclosure tools that should be used in addition to written disclosures. Instagram and Facebook offer a 'Paid Partnership' label. YouTube requires verbal disclosure in the video and a written disclosure in the description. TikTok has a built-in branded content toggle. Using these platform tools does not replace the requirement to include a written or verbal disclosure — both are recommended for full compliance.

5. What is not acceptable

The following disclosure practices are not compliant with FTC guidelines and may result in account action on Novetofy: placing disclosures only at the end of a long post or description, using vague language such as 'thanks to [Brand]' without clarifying the affiliate relationship, hiding disclosures behind a 'more' button or collapsed text, disclosing in a font size or color that makes it difficult to read, and omitting disclosure entirely on the assumption that your audience already knows you use affiliate links.

6. Novetofy's role

Novetofy provides creators with affiliate links and the tools to earn commissions. While we educate creators on FTC compliance requirements, the responsibility for proper disclosure rests entirely with you as the creator. Novetofy is not liable for any FTC violations committed by creators on our Platform. Failure to comply with FTC disclosure requirements may result in suspension or termination of your Novetofy account.

7. International creators

While FTC guidelines apply primarily to US-based creators and content targeting US audiences, many other countries have similar requirements. The UK's ASA, Canada's Competition Bureau, and the EU's Consumer Protection laws all have disclosure requirements for affiliate and sponsored content. Regardless of your location, Novetofy requires all creators to follow transparent disclosure practices as outlined in this policy.

8. Staying compliant

FTC guidelines evolve over time and we encourage all creators to stay informed. The FTC publishes guidance documents and endorsement guides on their official website at ftc.gov. Novetofy may also provide updated guidance through our creator resources and newsletter. When in doubt, disclose — over-disclosing is always safer than under-disclosing and builds trust with your audience.

9. Enforcement

Novetofy monitors creator content for compliance with our community standards, which include adherence to FTC disclosure requirements. Creators found to be consistently non-compliant may have their accounts reviewed, suspended, or permanently terminated. Withheld or reversed commissions may result from violations. We take this seriously because non-compliance puts both creators and our brand partners at legal risk.
